*In an order dated March 10, 1837, President Martin Van Buren allotted William Smith, who had been nominated and confirmed for a seat on the Supreme Court, to the Ninth Circuit. When Smith declined to join the Court, Van Buren nominated McKinley in his stead, and on June 28, 1837, issued a new order allotting McKinley to the Ninth Circuit.
