1. The act of February 26, 1919, 45 Stat. 1317, authorized a temporary judgeship for the court and provided that the next vacancy in the district not be filled. In accordance with the statute, no successor to James Elliott was appointed.
2. On December 9, 1953, the president certified Alfred Wyman involuntarily as disabled in accordance with the act of October 31, 1951, 65 Stat. 710, which entitled the president to appoint an additional judge for the court and provided that no successor to the judge certified as disabled be appointed.
3. The act of October 31, 1951, 65 Stat. 710, was made applicable to the District of South Dakota on December 9, 1953, when the president certified Judge Wyman as disabled. George Mickelson was appointed to the additional judgeship authorized by the statute.
