1. Fifteen judges were appointed pursuant to the act of April 2, 1982, 96 Stat. 27, which provided that the commissioners (also known as trial judges) of the U.S. Court of Claims would become judges of the newly-established U.S. Claims Court on October 1, 1982, the effective date of the statute. Alex Kozinski, one of the court's original sixteen judges and its first chief judge, had served as chief trial judge of the U.S. Court of Claims since August 1982, but did not receive a stautory appointment to the new court. Instead, he was nominated by the president and confirmed by the Senate. 2. No successors to original judges Lloyd Fletcher, Roald Hogenson, or George Willi -- all of whom retired shortly after the new court began operations -- were ever formally designated. Reginald Gibson, Lawrence Margolis, and H. Robert Mayer were appointed to "new" seats, despite not having been among the court's original sixteen judges. 3. Mastin White, a senior trial judge on the U.S. Court of Claims, was appointed a senior judge of the new court pursuant to the act of April 2, 1982, 96 Stat. 27, although the statute made no specific provision for such an appointment. Shortly thereafter, White received a presidential recess appointment as a judge in regular active service. He served in this capacity for nine days before once again assuming senior status. No successor to Judge White was ever designated. |
