Received a recess appointment from Theodore Roosevelt on March 18, 1907, to a new seat authorized by 34 Stat. 928; nominated to the same position by Theodore Roosevelt on December 3, 1907. Service terminated on May 30, 1908, after nomination was not confirmed by the Senate.
