Received a recess appointment from Theodore Roosevelt on November 11, 1907, to a new seat authorized by 34 Stat. 267; nominated to the same position by Theodore Roosevelt on December 3, 1907. Confirmed by the Senate on January 13, 1908, and received commission on January 13, 1908. Service terminated on August 31, 1918, due to resignation.
