1. The act of June 11, 1864, 13 Stat. 124, transferred this judgeship to the District of West Virginia.
2. Alfred Barksdale received a recess appointment to the court on December 19, 1939, although his predecessor, Armistead Dobie, did not formally terminate his service on the district court until February 8, 1940, when he began service on the U.S. Court of Appeals for the Fourth Circuit.
3. On November 6, 1967, the president certified Thomas Michie involuntarily as disabled in accordance with the act of September 2, 1957, 71 Stat. 586, which entitled the president to appoint an additional judge for the court and provided that no successor to the judge certified as disabled be appointed.
4. The act of September 2, 1957, 71 Stat. 586, was made applicable to the Western District of Virginia on November 6, 1967, when the president certified Judge Michie as disabled. Emory Widener was appointed to the additional judgeship authorized by the statute.
