Congress organized Texas as one judicial district and authorized one judgeship for the district court. The district court in Texas, not being assigned to a judicial circuit, was granted the same jurisdiction as U.S. circuit courts, except in appeals and writs of error, which were the jurisdiction of the Supreme Court.

Texas divided into two judicial districts, the Eastern and the Western, with one judgeship authorized for the court in each district.

The act repealed the circuit court jurisdiction of the district courts in Texas and established a U.S. circuit court for the district, which was assigned to Sixth Circuit.

Congress reassigned a portion of the jurisdiction held over the Indian Territory by the Western District of Arkansas to the Northern District of Texas (reassigning another portion to the District of Kansas). Congress reassigned the portion held by the Northern District of Texas to the Eastern District of Texas on March 1, 1889 (25 Stat. 786). Congress repealed the jurisdiction of district courts in Arkansas, Kansas, and Texas over the Indian Territory effective September 1, 1896 (28 Stat. 697).
