The Judiciary Act of 1789 established the U.S. Circuit Court for the District of Virginia and assigned the district to the Middle Circuit.

The Judiciary Act of 1801 established six regional circuit courts to replace the circuit courts organized by judicial districts. The Act divided Virginia into two judicial districts, the Eastern and the Western, and placed the them under the jurisdiction of the U.S. Circuit Court for the Fourth Circuit.

Congress repealed the Judiciary Act of 1801 and restored the organization of the judiciary in effect before 1801, thereby re-establishing the U.S. Circuit Court for the District of Virginia.

Judiciary Act of 1802 assigned the District of Virginia to the Fifth Circuit.

Congress divided Virginia into two judicial districts, the Eastern and the Western, and assigned the Eastern District to the Fifth Circuit. The U.S. District Court for the Western District, not being assigned to a judicial circuit, was granted the same jurisdiction as U.S. circuit courts, except in appeals and writs of error, which were the jurisdiction of the Supreme Court.

This act repealed the circuit court jurisdiction of the U.S. District Court for the Western District of Virginia and established a U.S. circuit court for the district.

The act restored to the U.S. District Court for the Western District the jurisdiction of a U.S. circuit court, except in appeals and writs of error, which were to be the jurisdiction of the U.S. circuit court meeting in Lewisburg.

Congress reorganized the judicial circuits and assigned the districts of Virginia to the Fourth Circuit.

Following the admission of West Virginia into the Union, this act reorganized Virginia as one judicial district, with one U.S. district court and one U.S. circuit court.

This act divided Virginia into the eastern and the western judicial districts and created a U.S. circuit court in each district.
