A description of a rule adopted by the Eastern District of Michigan that permits a judge to refer diversity cases to a mediation panel and to impose certain costs as a penalty if a resulting trial does not improve on the award suggested by the panel. The report also presents the impressions of judges who have referred cases to the district's mediation program.
