1. Pursuant to the act of December 1, 1990, 104 Stat. 5089, no successor to Edward Harrington was appointed because his was the first seat to become vacant following Rya Zobel's return to the court in 1999 from her appointment as director of the Federal Judicial Center.
2. The act of December 1, 1990, 104 Stat. 5089, provided for the appointment of an additional judge for the court if an active judge assumed "the duties of a full-time office of Federal judicial administration." Rya Zobel became director of the Federal Judicial Center in April 1995, and George O'Toole was appointed to the additional judgeship authorized by the statute.
